1. Acceptance of Terms

By accessing or using the Mailverick platform ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Mailverick is a transactional email delivery platform providing REST API and SMTP relay services for sending transactional emails. The Service is not intended for marketing emails, bulk promotional campaigns, or unsolicited communications.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials, including API keys. You must notify us immediately of any unauthorized access.

4. Acceptable Use

You agree not to:

• Send unsolicited bulk email (spam) or marketing campaigns.
• Send content that is illegal, harmful, threatening, abusive, or violates third-party rights.
• Use the Service to harvest email addresses or distribute malware.
• Attempt to bypass sending limits, rate limits, or security measures.
• Resell access to the Service without a written agreement.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Email Sending Requirements

To maintain deliverability and protect shared infrastructure, you must comply with the following requirements:

• Bounce rate: Your hard bounce rate must remain below your plan's warning threshold. Accounts exceeding the critical threshold may be suspended. Both thresholds depend on your plan.
• Spam complaint rate: Your spam complaint rate must remain below your plan's warning threshold. Accounts exceeding the critical threshold may be suspended. Both thresholds depend on your plan.
• List hygiene: You are responsible for maintaining clean recipient lists. Do not send to addresses that have previously hard-bounced or filed spam complaints.
• Authentication: You must configure SPF and DKIM records for all sending domains as instructed by the platform. DMARC configuration is recommended for all accounts and mandatory for accounts sending more than 5,000 emails per day.
• Content requirements: Emails must include a valid sender address and must not contain deceptive headers or misleading subject lines.

We monitor these metrics continuously. Accounts that consistently exceed these thresholds will receive warnings before suspension. In severe cases, immediate suspension may occur to protect shared IP reputation.

Your current bounce and spam rates, along with the warning and critical thresholds for your plan, are visible at any time on your account page.

6. Service Plans and Billing

Plans are billed monthly based on email volume. Each plan has a fixed volume cap; sending stops when the cap is reached. Only Enterprise plans may include overage provisions. Prices are listed in EUR and are subject to applicable taxes.

7. Uptime and Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for interruptions caused by factors beyond our control.

8. Data and Privacy

Your use of the Service is subject to our Privacy Policy. You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consents from email recipients.

9. Intellectual Property

The Service, including its design, code, and documentation, is the property of Mailverick. You retain ownership of the content you send through the Service. We do not claim any rights over your email content or templates.

10. Limitation of Liability

To the maximum extent permitted by law, Mailverick shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

11. Termination

You may close your account at any time. We may suspend or terminate your account for violation of these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. Material changes will be communicated via email or through the Service.

13. Governing Law

These Terms are governed by the laws of the European Union and the applicable member state where Mailverick is established. Disputes shall be resolved in the competent courts of that jurisdiction.
